PARTIES AND NOISE: Amplified music is not allowed outside the property. The tenant agrees not to bring speakers outside and to not crank up the music playing inside so it can be also heard outside. Parties and/or events of any kind are strictly prohibited at the property. For the purposes of this rental agreement, all parts will consider that there is a party inside the property whenever the number of daytime occupants in the unit exceeds the maximum number of daytime occupants for this unit. Notwithstanding the former prevision, even if the maximum number of daytime occupants is not exceeded, all other common definitions of a party will be accepted, whenever the noise level inside the unit is beyond what is reasonable accepted as normal. In the event that a non-authorised party or event takes place at the unit, Tenant risks forfeiting the entire security deposit in addition to any costs associated with legal remedies that may be necessary. Tenant agrees to keep the noise level inside the unit under respectable levels, so as to not interfere with the peace and quiet of the neighbours and any person outside the boundaries of the property. The tenant agrees to conform to all provisions and city ordinances per the relevant Municipal Code. Failure of Tenant to adhere to City regulations will be considered a breach of this rental agreement. The tenant risks the forfeiture of the deposit, should any complaint about the noise level inside the property arise with the local police or the local city authorities. Furthermore, the Tenant recognises the right of the manager to ask Tenant and Tenant's guests to vacate the property immediately if it becomes necessary and no refund of any portion of the rental amount.
ADDITIONAL OCCUPANTS: If more than the agreed number of overnight occupants as described in the Reservation Summary spend the night at the property, or more than double the maximum number of overnight occupants as described in the property website are at any given time inside the unit, Tenant risks forfeiting part or all of the security deposit. At a minimum we will charge $100 per person per night that is found to be staying at the property without prior written agreement.
SMOKING: Smoking inside the unit is strictly prohibited. Our non-smoking policy includes all immediate external areas and decks. Tenant risks forfeiting their security deposit in addition to any associated cleaning costs. A minimum charge of $250 will apply per reported incident.
FILMING: The filming of any still or motion pictures in any format that requires more than 2 persons and/or any specialised gear, apparatus or crew is strictly prohibited unless prior written authorisation is obtained. Failure to obtain written authorisation may result in full deposit forfeiture.
CHECK IN: Unless agreed differently by the Owner in writing, check-in is any time after 2:00 PM or upon agreement with the property manager/owner. The Owner will send Tenant the instructions for a self check-in 3 days before arrival. Once Tenant has checked into the property or he/she has been granted access, Tenant accepts the condition, size and configuration of the Rental Premises in as/is where/is condition and accepts full financial responsibility per this agreement. If for any reason Tenant considers the property as not acceptable, Tenant must notify the Owner immediately, so that the Owner can attempt to remedy the situation to the Tenant's satisfaction.
CHECK OUT: By 10:00 am. A later check-out may be exceptionally granted but only if these two conditions are met: 1. there is no new arrival checking into the property on the day of tenant's departure and 2. the request for a late check-out is made within twenty-four hours prior to the check-out date stated on the agreement. Charges for a late check-out not timely requested will be made against your security deposit for a minimum of $100 per hour for the first two hours after which we will charge an additional full day accommodation cost, such charges do not equate to you purchasing a day of accommodation. Please lock the entrance door when you leave.
CLEANING: The property will be inspected and cleaned after your departure which will be covered by your cleaning fee. You are required to leave the property in the same general condition that you received it. Make sure the dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitised. If additional cleaning is required, appropriate charges will be deducted from your security deposit at the rate of $30 per hour.
WHAT YOU SHOULD BRING: Plan on packing your personal toiletry items. We provide toilet paper, paper towels, and other dispensable items to get you started on your first day of your stay, however, you should plan on making a trip to the grocery store to replenish these items as you need them.
WATER USAGE: Water is precious in Australia and we are often in drought conditions. Please use water in moderation when you shower.
TENANT'S LIABILITY: Tenant agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant or Tenants guests, including, but not limited to misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, the Tenant agrees to reimburse owners for costs incurred to repair/replace damaged items.
HOLD HARMLESS: Owner(s) / Manager(s) do not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, phone, internet, cable or satellite TV, or electricity services or plumbing. Nor will Owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control. The foregoing notwithstanding, Owner(s)/Manager(s) will use good faith efforts to remedy any deficient condition following notice.
DECKS: The undersigned is fully aware that decks can be dangerous and slippery when wet, and that injury can occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the decks. It is utterly prohibited to climb on roofs, railings or trees.
ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from.
PERSONAL PROPERTY LEFT BEHIND: If found, any items left behind will be mailed back upon request. The cost of shipping, shipping container and any packing materials will be requested via Airbnb payment request form and may include a handling fee.
TENANT AS SUBJECT OF THE LAW: The tenant acknowledges that during the length of the rental period, the Tenant and his/her guests is/are subject to all State and Federal laws, Area Ordinances and City regulations valid within the jurisdiction where the Property is located. Owner(s) and/or Manager(s) are neither responsible to inform Tenant of these laws, ordinances and city regulations, nor could Owner(s) and/or Manager be held liable should Tenant(s) and/or Tenant's guests commit a crime, misdemeanour, felony or infraction (including parking infractions).
UTILITIES: If the Air Conditioning is used excessively additional charges may apply. We have accounted for consumption of gas and electric up to $10.00 / day is included.
Third party amenities, such as electricity, gas, and internet are beyond our control. In the event of service interruption beyond our control, you agree by checking in to your reservation that you are not entitled to, nor will you seek compensation of any kind, including partial or complete refunds for any such interruption.
